HARDEEP SINGH ...Petitioner
Versus
GAURAV YADAV IPS DGP AND OTHERS ...Respondents
CORAM : HON'BLE MR. JUSTICE RAJBIR SEHRAWAT
Present:- Mr. Chetan Sehgal, Advocate,
for the petitioner.
RAJBIR SEHRAWAT, J. (Oral)
1. This is a contempt petition filed under Sections 10 and 12 of
the Contempt of Courts Act, for punishing the respondents for disobeying
the notification No.159 dated 22.09.2023 issued in pursuance of the
directions issued by the Hon'ble Supreme Court in the judgment dated
31.07.2023 passed in Crl. Appeal No.2207-2023.
2. In view of the facts and circumstances of the case, as well as,
the nature of the order itself, for determination of contempt qua that order;
a lot of disputed questions would be required to be adjudicated upon.
However, adjudication of the disputed questions of fact would not even be
appropriate in the contempt proceedings. Hence, the present petition is
dismissed.
3. However, the petitioner would be at liberty to avail any other
alternate remedy for initiating action against the police official(s), but in
accordance with law.
