1. This is an old appeal, which is pending for the last 30 years.

2. As per the office report, the appellant had died and two of his

legal representatives have been served with the notice from the Court,

however, they remain unrepresented.

3. A perusal of the paperbook proves that this appeal has been

filed by the plaintiff to challenge the correctness of the First Appellate

Court's judgment by which the judgment and decree passed by the trial

Court has been reversed resulting in dismissal of plaintiff's suit for recovery

of Rs.41,280/-.

4. It appears that the appellants are not interested in prosecuting

the appeal.

5. Hence, dismissed for non-prosecution.

6. All the pending miscellaneous applications, if any, are also

disposed of.
