Learned counsel for the petitioner contends that case of the petitioner

falls within the policy dated 11.08.2008 (Annexure P-1) for his pre-mature

release as petitioner has already undergone more than 23 years imprisonment

including the remission. Learned counsel has referred to a detailed judgment

passed by a co-ordinate Bench of this Court in CRWP-8232-2022 (O&M) titled

"Pohlu @ Polu Ram v. State of Haryana and Others" decided on 05.02.2024

(Annexure P-2); and another judgment dated 19.12.2023 passed by this Court in

CRWP-4366-2022 titled "Shiv Kumar v. State of Haryana and Others". Learned

counsel further submits that petitioner had moved an application dated

26.03.2024 (Annexure P-3) for his pre-mature release to the concerned authorities

but no action has been taken.

Mr. Parveen Kumar Aggarwal, DAG, Haryana accepts notice on

behalf of respondents- State.

This petition is hereby disposed of with the direction to the

respondents to take decision on the application (Annexure P-3) of the petitioner,

within a period of 02 months positively, in accordance with law and also in light

of the legal position as explained in CRWP-8232-2022 (O&M) titled as "Pohlu

@ Polu Ram v. State of Haryana and Others" (Annexure P-2) decided on

05.02.2024 & CRWP-4366-2022 titled as "Shiv Kumar v. State of Haryana and

Others" (Annexure P-3) decided on 26.03.2024.
