1. Instant application has been filed under Section 378 (4) of the

Code of Criminal Procedure seeking grant of leave to file the present appeal

by the applicant against judgment dated 30.01.2017 passed by learned Sub

Divisional Judicial Magistrate, Derabassi, whereby respondent No.1 has

been acquitted.

2. Counsel for respondent No.1 submits that both the applicant as

well as respondent No.1 have expired. He submits that the matter has

become infructuous.

3. Counsel for the applicant does not have any instructions.

4. Dismissed as having been rendered infructuous. However,

liberty is granted to the parties to seek revival, in case the situation is

otherwise.
