1. The petitioner through instant petition under Articles 226/227 of

the Constitution of India is seeking direction to respondents to issue his

passport.

2. An FIR No. 71 dated 30.03.2007, under Sections 302, 323, 324,

148 and 149 of IPC, Section 25 of the Arms Act and Section 3 of the

Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, was

registered against the petitioner at Police Station Majitha, District Amritsar.

The petitioner came to be convicted vide judgment dated 21.02.2011. The

petitioner preferred CRA-D-270-DB of 2011 before this Court. The

sentence of the petitioner has been suspended vide order dated 20.12.2011.

The petitioner moved an application in 2016 seeking passport which was

closed on account of pendency of criminal case.

3. Learned counsel for the petitioner submits that case of the

petitioner is squarely covered by judgment of this Court in Mohan Lal @

Mohna vs. Union of India and others, CWP No. 27167 of 2018.

4. Learned counsel for Union of India submits that as on date, no

application of the petitioner is pending before the passport authorities. If the

petitioner moves an application, it would be decided considering the

aforesaid judgment within six weeks from the date of application.

5. In the wake of statement of learned counsel for Union of India,

the petition stands disposed of.
