For the reasons as are mentioned in the application, the same

to today and the main case is taken up for hearing today itself.

[1] Challenge in the instant petition is to order, Annexure P/6

dated 26.11.2019 whereby objections to the Local Commissioner report

were summarily dismissed without framing issues as also opportunity to

adduce evidence.

[2] At the outset, learned counsel for the petitioner states that in

view of Civil Suit No.1127 of 2015, out of which the instant petition

arises having been decided vide judgment and decree dated 07.01.2023,

he does not press the instant petition and may be permitted to withdraw

the same.

[3]          In view of the position noted above as well as the statement

of learned counsel for the petitioner, the instant petition is dismissed as

withdrawn.
