This is the defendants/appellants, second appeal against the

judgment and decree dated 04.09.1996 passed by the Ist Appellate Court,

dismissing the appeal filed by the appellants herein against the judgment

and decree dated 10.11.1993 rendered by the learned trial Court, vide

which the 'suit for declaration' filed by plaintiff/respondent herein was

decreed with costs declaring him as the life member of the Governing

Council of Guru Hargobind Khalsa College Gurusar Sudhar and the

resolution dated 24.04.1966 qua removal of plaintiff/respondent, was set

aside.

At the outset, learned counsel for the appellants submits that

during the pendency of the present appeal, the plaintiff/respondent

expired on 04.08.2008, therefore, nothing survives in the present appeal

and the same may be disposed of, accordingly.

Learned Senior Counsel for the plaintiff/respondent submits

that he has 'no objection', in case the present appeal is disposed of, as

above.

In view of the foregoing circumstances, as statedly nothing

survives in the present appeal, the same is disposed of, accordingly.

Pending application(s), if any, also stand disposed of.
