This is an application under Section 5 of the Limitation Act for
condonation of delay of 59 days in filing the present appeal.
I have heard learned counsel for the applicants/appellant and
also gone through the case file. This Court does not find any sufficient
ground to condone the delay of 59 days in filing the present appeal.
Accordingly, the present application stands dismissed.

The present regular second appeal has been preferred by the
appellants/defendants against the judgment and decree dated 15.09.2018
passed by the Additional Civil Judge (Senior Division), Tohana, decreeing
the suit for declaration in favour of the respondent/plaintiff, as well as, the
judgment and decree dated 12.07.2019 passed by the District Judge,

Fatehabad, whereby the appeal filed by the appellants/defendants has been
dismissed.
In view of the fact that the application for condonation of delay
has been dismissed, the present appeal, as well as, the application for staying
the execution of the impugned judgments and decree passed by the Courts
below have been rendered infructuous.
