Admittedly, the earlier writ petition filed by the
petitioner was withdrawn in order to file a civil suit. The civil suit
was filed by the petitioner and the same was dismissed on
17.01.2019. In the interregnum, certain writ petitions filed in the
High Court in the year 2012 were decided. Instead of
challenging the judgment and decree of the trial Court before
the lower Appellate Court, the petitioner has again come to the
High Court in order to seek parity with those petitioners whose
writ petitions have been decided subsequently.
No indulgence can be granted. Petitioner, if so
advised may challenge judgment and decree of the trial Court in
appeal. Petitioner would also be at liberty to seek condonation

of delay by referring to Section 14 of Limitation Act in
accordance with law.
With these observations, this writ petition is
dismissed.
