At the outset, the learned counsel for the
petitioners submits that in the light of the judgment passed by
this Court in L.P.A. No. 458 of 2021 (Srikant Dubey @ Shri
Kant Dubey and Ors. Vrs. The State of Bihar and Ors.), the
petitioners are also entitled to get benefit of 1st A.C.P. He further
submits that the petitioners herein have already made their
representation before the concerned respondent vide Annexure-9
series, which is still pending, therefore, it is prayed by him that
the petition may be disposed of directing the concerned
respondent to consider and decide the same within the stipulated
period fixed by this Court.
2. On the basis of the above submission made by
the counsel, the writ petition is disposed of. The concerned
respondent is directed to consider and decide the pending
representation of the petitioners (Annexure-9 series) as early as
possible probably within 60 days from the date of
receipt/production of a copy of this order in accordance with
rules and law and further taking into consideration the
Patna High Court CWJC No.9499 of 2025 dt.26-06-2025
observation made by the Co-ordinate Bench of this Court in
L.P.A. No. 458 of 2021 (Srikant Dubey @ Shri Kant Dubey
and Ors. Vrs. The State of Bihar and Ors).
