Heard learned counsel for the parties.
Petitioner has prayed for the following relief(s).
"1. That this writ application is being filed for a direction upon the respondents concerned to consider the Cash Credit Account of the petitioner's firm, being A/c No. 0380008700008024, opened with Respondent No. 3 for granting benefit of restructuring in vie of the beneficial guideline issued by Reserve Bank of India vide Notification RBI/ 2019-2020/160, dated 11.02.2020 (Annexure-4), as the Respondent Bank ignoring the spirit of the notification classified the said account of Patna High Court CWJC No.10304 of 2020 dt.21-12-2021
the petitioner as non- Performing Assets, which has caused huge loss to the functioning of business, credit prestige and mental agony of the petitioner and allow the writ petition of the petitioner with cost, penal interest and cost of litigation."
After some argument, learned counsel for the
petitioner seeks permission to withdraw this petition with liberty
to approach the appropriate/competent forum for redressal of his
grievances as permissible in law.
This application is dismissed as withdrawn
reserving liberty to the writ petitioner to take recourse to such
remedies as are otherwise available in accordance with law.
However, it is made clear that this Court has not
expressed any opinion on the merits of the case and all issues of
facts and law are left open.
