07. 1. This Land Acquisition Appeal has been preferred by the appellant-State challenging the impugned judgment/award dated 28th September, 2012 passed by the learned Civil Judge (Senior Division), Sambalpur in L.A. Misc. Case No.26 of 2003.

2. Learned Additional Standing Counsel appearing for the appellant-State, by furnishing a letter no.389, dated 21st June, 2016 issued by the Special Land Acquisition Officer, Talacher- Sambalpur Rail Link, Sambalpur, submitted that since the decretal amount of Rs.8,48,231.30 (rupees eight lakh forty eight thousand two hundred thirty one and paise thirty only), as awarded by the learned Civil Judge (Senior Division), Sambalpur vide impugned judgment/award dated 28th September, 2012 in L.A. Misc. Case No.26 of 2003, has already been paid to the decree holders (respondent nos.1, 2 and 3 herein) through Account Payee Cheque bearing No.543824, dated 30th April,

2016 of Bank of Baroda, Sambalpur, this Land Acquisition Appeal may be disposed of as the appellant shall not be interested to pursue the appeal. The letter dated 21st June, 2016 furnished by the learned Additional Standing Counsel is taken on record.

3. In view of the above submission of the learned Additional Standing Counsel appearing for the appellant-State, this Land Acquisition Appeal stands disposed of as withdrawn.
