01. 1. Heard Mr. S. Mohanty, learned counsel for the petitioners and Mr. D. Nayak, learned AGA for State -opposite parties.

2. It is submitted on behalf of the petitioners that despite they submitted their show cause under Annexure-3 in Encroachment Case No.4-306 of 2025 since long, but without considering the same a fresh notice of eviction has been issued again on 13th January, 2026 under Annexure-6.

3. Considering such limited grievance of the petitioners, the writ petition is disposed of at the stage of admission with a direction to the Tahasildar, Gondia (O.P. No.3) to grant due opportunity of hearing to the petitioners and take decision, in accordance with law, before their eviction from the case land, within a period of two months from the date of receipt of certified copy of this order along with a copy of the writ petition. Till such decision is taken by opposite party no.3, the petitioners may not be evicted from the case land.

4. An urgent certified copy of this order shall be issued on proper application.
