IN THE HIGH COURT OF ORISSA AT CUTTACK
                       CRL. REV. No.176 of 2024

         Gautam Kumar V.K.
         Burra .... Petitioner
                                     Mr. L. Sarangi, Advocate
                                 -versus-

Shaik Gousia Begum .... Opposite Party

                   CORAM: JUSTICE V. NARASINGH
                              ORDER
Order 21.01.2026
No.
  03. 1. Heard learned counsel for the Petitioner and

the learned counsel for the State.

2. In this Criminal Revision the Petitioner assails the order 1.2.2024 passed by the learned Addl. Sessions Judge-IV, Bhubaneswar in Criminal Appeal No.68 of 2022 affirming the order dated 20.10.2022 passed by the learned J.M.F.C, Jatni in CMC No.72 of 2021 by which challenge of the Petitioner under Section 29 of the Protection of Women from Domestic Violence Act, 2005 directing the Petitioner as Appellant to pay a sum of Rs.2000/- was not entertained.

3. It is submitted by the learned counsel for the Petitioner, Mr. Sarangi that the Petitioner is an unemployed person and direction for payment of Rs.2000/- is very harsh and because of the conduct

of the Opposite Party-wife, the Petitioner has been rendered unemployed and he had taken loans to support the Opposite Party-wife and that ought to weigh with the learned appellate court in considering the prayer.

4. This Court perused the judgment assailed. On going through the same, this Court does not find any infirmity in the impugned order.

So far as exercising the revisional jurisdiction is concerned, this Court respectfully refers to the guidelines issued by the Apex Court in the case of Amit Kapoor vrs. Ramesh Chander, (2012) 9 SCC 460.

5. Accordingly, the Criminal Revision stands rejected.
