01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioners.
3. On perusal of the subject matter of dispute in the present CMP application, this Court is of the view that the settlement in a Lok Adalat can only be assailed by filing a writ petition under Article 226 and 227 of the Constitution of India. Therefore, the nomenclature should have been WPC instead of CMP. Learned counsel for the Petitioner also relied upon a judgment in the case of Biswaranjan Sahoo and Another v. Bijay Kumar Sahoo and Others decided in W.P.(C) No.33760 of 2022 in favour of his contention.
4. In such view of the matter, Registry is directed to verify the
same, if required, the nomenclature shall be corrected and the matter may be re-registered and be placed before the appropriate assigned bench in the next week.
