The petitioner is an accused in connection with Baidyanathpur P.S. Case No.382 of 2024 corresponding to S.T. Case No.472 of 2024 corresponding to G.R. Case No.1671 of 2024 registered for the alleged commission of the offences punishable under Sections 103(1)/3(5) of the BNS, 2023, pending in the Court of the learned Sessions Judge, Ganjam, Berhampur. The petitioner had approached the learned Sessions Judge, Ganjam, Berhampur in S.T. Case No.472 of 2024 praying for grant of bail. The learned Court below vide its order dated 17.03.2026 rejected the bail application of the petitioner. Being aggrieved, the petitioner has filed the present petition under Section 483 of BNSS, 2023 praying for enlargement on bail.
2. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.
3. The prosecution case is that on 16.08.2024 at about 11 a.m., the complainant was directed to enquire into B.N.Pur P.S. U.D. Case No.539 of 2024. As per the direction, he conducted the inquest over the dead body of the deceased Garibabandhu Panda of Ajodhya Nagar. During the enquiry, Sandeep Panda, son of the deceased Garibabandhu Panda and one transgender told lie to save themselves and stated that their father fell down on the hard surface inside the house on 15.08.2024 at about 5 P.M. due to severe pain in his leg. At the time of P.M. examination, it was found that the ribs of the deceased have been fractured and there were lot of bleeding injuries on the body of the deceased. Hence, the case.
4. Learned counsel for the State submits that the petitioner is the son of the deceased, who has been killed by his living partner and the petitioner has actively participated in the crime. The vital witnesses have not yet been examined in the present case.
5. In view of the aforementioned, I am not inclined to grant bail to the petitioner at this stage. However, it is
open for the petitioner, to renew his bail plea before the trial Court after the vital witnesses including the informant are examined in the present case.
6. With the aforementioned observation, the BLAPL is disposed of.
