04. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is an application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Orkel P.S. Case No. 221 of 2025 corresponding to Special G.R. Case No. 106 of 2025 pending in the Court of learned Sessions Judge-cum-Special Judge, Malkangiri for commission of offence punishable U/Ss. 20(b)(ii)(C)/29 of NDPS Act, on the main allegation of possessing 105Kgs of Contraband Ganja.

3. Heard, Mr. Satyajeet Rout, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record.

4. After having considered the rival submissions and taking into consideration the nature and gravity of the offences vis-à-vis the accusations sought to be brought against him and regard being had to the recovery and seizure of such a huge quantity of Contraband Ganja to the tune of 105Kgs, which is well above the commercial quantity allegedly from the

possession of the petitioner and his consequent failure to satisfy the conditions of Sec.37 of NDPS Act, which is sine qua non for grant of bail for commission of offence under NDPS Act involving commercial quantity, this Court is not inclined to grant bail to the petitioner.

Hence, the prayer for bail of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately forwarded to the court in seisin over the matter for reference.
