03. CRLA NO.1115 OF 2024 & I.A. NO.2508 of 2024

1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. This is an application for condonation of delay of 186 days in preparing and presenting the appeal before this Court.

3. Heard learned counsel for the Appellant-Petitioner as well as the learned Additional Standing Counsel for the State-Respondent.

4. The present appeal has been directed against the judgment dated 29.01.2024 passed in Criminal Trial No.30 of 201 which corresponds to T.R.No.07 of 2022 by the learned Special Judge, Kandhamal, Phulbani therby convicting the convict-appellant under sections 450,

376(1)/34 of the Indian Penal Code and Section 376-D of the Indian Penal Code.

5. Learned counsel for the Appellant-Petitioner at the outset contended that the Appellant-Petitioner is in custody since 26.03.2021. After his conviction, the Appellant- Petitioner found difficult to arrange money and engage an advocate to prefer an appeal. However, in the meantime, he has presented the appeal by engaging a counsel although there was some delay.

6. Taking into consideration the nature of conviction and gravity of the punishment imposed and the crime alleged against him, this Court is inclined to condone the delay in preferring the present appeal.

7. Accordingly, the I.A. is disposed of.

8. List this CRLA no.1115 of 2024 next week for admission.
