01. 1. This matter is taken up through Hybrid mode.
2. Heard the learned counsel for the Petitioner as well as learned counsel for the Contemnor.
3. The present contempt application has been filed alleging non- compliance of the judgment dated 02.04.2025 passed by this Court in W.P.(C) No.6925 of 2024.
4. Learned counsel for the Petitioner, at the outset, contended that vide judgment dated 02.04.2025, this Court directed the Opposite Party-Contemnor to give promotion to the Petitioner to the post of Administrative Officer by convening a review DPC from the date his immediate junior was given such promotion. A further direction was
given to the Contemnor to pay all service and consequential benefits as is due and admissible to the Petitioner.
5. Learned counsel for the Petitioner, at this juncture, contended that although the Petitioner has been given promotion in compliance to the first part of direction, however, he has not been paid his financial benefits as is due and admissible to him.
6. Learned counsel for the Contemnor submitted that steps have been taken to implement the aforesaid judgment in its entirety. As such, they need some more time.
7. Taking into consideration the submission made by the learned counsel for the Contemnor, as a last chance, the Contemnor is granted six weeks' time to implement the judgment dated 02.04.2025 passed by this Court in W.P.(C) No.6925 of 2024 in its letter and spirit, failing which, the Contemnor shall be asked to appear in person before this Court and to explain as to why a proceeding under the Contempt of Courts Act shall not be initiated against him for wilful and deliberate violation of this Court's judgment.
8. With the aforesaid observation and direction, the contempt petition is disposed of.
