01. 1. This matter is taken up through hybrid mode.

2. Heard Mr. A.C.Panda, learned Counsel for the appellant, on the question of admission. Perused the judgments passed by the lower appellate Court as well as the trial Court.

3. Considering the submissions and the grounds raised, the RSA is admitted on the following substantial questions of law;

(i) Whether the impugned judgment is sustainable which has been decided without disposing the application U/0-41, Rule-27 C.P.C?

(ii) Whether the First Appellate Court was correct in dismissing the appeal when the parties had already settled their dispute amicably and sought to bring the proof of such settlement by way of additional evidence, which was refused?

4. Call for the L.C.R.

5. Issue notice to the Respondents by Speed Post/Registered Post making it returnable within four weeks. Requisites be filed within three working days.

6. List this matter in the month of February, 2026.
