01. 1. Heard Mr. Pradhan, learned counsel for the petitioner.

2. Instant revision is filed by the petitioner challenging the impugned order dated 18th March, 2024 as at Annexure-3 in C.T. Case No.420 of 2016, whereby, charge under Section 420 IPC has been framed against him.

3. Referring to the judgment in C.S. No.548 of 2010 at Annexure-5, Mr. Pradhan, learned counsel for the petitioner submits that the informant, namely, opposite party No.2 lodged the FIR with false allegations made and it has resulted in filing of the chargesheet i.e. Annexure-2 and that too for an offence under Section 420 IPC, which is not made out at all.

4. Considering the facts on record and the submission as above, this Court is inclined to issue notice to opposite party No.2 and also to consider the response of the State, namely, opposite party No.1.

5. Accordingly, it is ordered.

6. Notice.

7. Mr. Ray, learned AGA for the State accepts notice for opposite party No.1.

8. Notice to opposite party No.2 by Registered Post with A.D. returnable at an early date and for the said purpose, requisites shall be filed by Mr. Pradhan, learned counsel for the petitioner within seven days from today.

9. List this matter on 13th October, 2025.

2. Instant petition is filed for interim orders.

3. As an interim measure, awaiting response from the State and the appearance of opposite party No.2, this Court, stays the further proceeding in C.T. Case No.420 of 2016 pending in the file of learned J.M.F.C. 1, Bhubaneswar till the next date of hearing.

4. List on the date fixed for further orders.

5. Issue urgent certified copy as per rules.
