   05.       1.      This   matter   is   taken       up   through    Hybrid

Arrangement (Virtual/Physical Mode).

2. Mr. Devashis Panda, learned counsel for the petitioner, by producing an affidavit stated to be sworn in by the petitioner submits that although the petitioner is an innocent person, but he is ready and willing to submit to the jurisdiction of the Court of Zambia in the event of his enlargement on bail, however, subject to release of his passport which has been seized in this case. It is further submitted by Mr.Panda that the petitioner is in custody since 15.05.2025, no matter he cannot be prosecuted in India for offences committed by him beyond the territorial jurisdiction of India in view of the provision of Sec.188 of CrPC/208 of BNSS even if the materials on record are taken into consideration

3. In reply, Mr. Siddhant Mohanty, learned counsel for the informant submits that he has in fact no

objection for grant of bail to the petitioner, if the petitioner submits to the jurisdiction of the Zambia Court, but there should be some time frame and the passport impounded in this case may be released in favour of the petitioner so as to allow him to go to Zambia.

4. Mr. P. Satpathy, learned Addl. PP, however, without disputing the provisions of law submits that since the petitioner has prima facie committed offences, he should not be enlarged on bail.

5. Argument being heard, judgment is reserved.
