01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the parties and perused the records.

3. The present Criminal Miscellaneous Case has been filed by the Petitioner seeking a direction to the trial court to consider his bail application afresh taking into account of the judgment passed by the Hon'ble Apex Court in the case of Hussainara Khatoon(1) v. State of Bihar, reported in (1980) 1 SCC 81, in connection with C.T. Case No.23/2023 pending in file of the learned Additional Sessions Judge-cum-Special Judge, Jeypore.

4. Learned counsel for the Petitioner, at the outset, contended that the Petitioner does not want to press this application and seeks

permission to withdraw the same with liberty to raise all the points at a later stage by filing an appropriate application.

5. Considering such submission, this CRLMC stands disposed of as withdrawn with the liberty as sought for.

6. Further, taking into consideration the submission made by the learned counsel for the Petitioner that the Petitioner is in custody since 06.10.2022, the Petitioner is granted liberty to move an application for bail before the court in seisin over the matter within three weeks hence. In such eventuality, the court in seisin over the matter shall consider and dispose of the bail application of the Petitioner keeping in view the principle laid down by the Hon'ble Apex Court in the case of Hussainara Khatoon(1) v. State of Bihar, reported in (1980) 1 SCC 81, as expeditiously as possible. It is made clear that this Court does not express any opinion on the merits of the matter.

Issue urgent certified copy of this order as per Rules.
