04. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. None appears for the parties. Perused the petition as well as the impugned judgment.

3. The present application has been filed under Section 378(4) of the Cr.P.C seeking leave to prefer an appeal against the judgment 30.03.2010 passed in 1.C.C. case No.157 of 2009 by the learned JMFC, Jagatsinghpur thereby acquitting the accused- Opposite Party.

4. On perusal of the record it appears that the impugned judgment of acquittal was delivered on 30.03.2010. However, till date no leave has been granted. On perusal of the record it appears that 01.12.2023, no one appeared for the Petitioner. Today also when the matter was called, no one appears for the Petitioner.

5. Accordingly, the application stands dismissed due to none- prosecution.
