05. IA No.1026 of 2025

1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is an application by the petitioner for waiving out the condition No.(iii) and modify the condition No.(iv) of paragraph-5 of the judgment dated 24.09.2025 passed in BLAPL No.6776 of 2025.

3. Heard, Mr. Bigyana Kumar Sharma, learned Senior Counsel, who is being assisted by Ms. I. Tripathy, learned counsel for the petitioner and Mr. A. Pradhan, learned Additional Public Prosecutor in the matter and perused the record.

4. After having considered the rival submissions and on going through the averments taken in the IA and considering the same in the light of difficulty experienced by the petitioner, this Court completely waives out the condition No.5(iii), but slightly modifies the condition No.5(iv) to the extent that "the petitioner

shall report attendance before the Jurisdictional Police Station once in a month preferably on a Sunday in between 10 AM to 12 Noon for six(06) months from the actual date of release from custody". Rest part of the order remains unaltered.

5. Hence, the IA stands disposed of.
