09. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Perused the order dated 23.09.2024 passed by the Hon'ble Supreme Court of India in Civil Appeal No. 10833 of 2024 which arises out of S.L.P.(Civil) No.22479 of 2024 and other connected Civil Appeals which were disposed of by a common order dated 23.09.2024.

It appears that the State of Odisha challenged the order dated 07.02.2013 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.1451 (C) of 2003 and this Court vide order dated 20.09.2022 has been pleased to dismiss the writ petition on the ground of delay and laches keeping in view the judgment of this Court in the case of State of Odisha

-Vrs.- Surama Manjari Das (W.P.(C) No. 15763 of 2021 dismissed on 16.07.2021). The State of Odisha challenged the said order before the Hon'ble Supreme Court and the Hon'ble Supreme Court vide common order dated 23.09.2024 has been pleased to set aside the order passed by the Division Bench of this Court and remitted the matters to this Court for

adjudication on merit in all these cases.

Learned counsel for the State submitted that in all the matters, notices have been issued and the opposite parties 1 to 5 entered appearance through their counsel and even show cause has already been filed by the Commissioner -cum- Secretary to the Government, School and Mass Education Department.

Learned counsel appearing for opposite party nos.1 to 5 submits that after dismissal of the writ petition way back in 2022, the opposite party nos.1 to 5 have already taken back their files and therefore, fresh notice be issued to the said opposite parties.

Learned counsel for the State also fairly submits that he will take immediate steps for issuance of notice to the opposite party nos.1 to 5.

In view of such submission, let fresh notice be issued to opposite party nos.1 to 5 by speed post/registered post, requisites for which shall be filed by 31st October 2025. The notice shall be made returnable within four weeks.

List this matter in the week commencing from 1st December 2025 along with W.P.(C) No. 2920 2016.

Counter affidavit, if any, may be filed in the meantime after serving a copy of the same on the learned counsel for the respective parties.
