                                             Mr. S.J. Mohanty, A.S.C.

                         CORAM:
                   REGISTRAR (JUDICIAL)

                           ORDER

22.10.2025 Order No.

9. Heard further learned counsel for the petitioner and the learned A.S.C. Perused the case record and order dated 06.11.2020 passed in W.P.(C) No.20766 of 2020 and order dated 02.05.2025 passed in WP(C) No.11280 of 2025.

During hearing, Mr. Mohanty, learned A.S.C. filed photocopy of order number 7195/SME, dated 30.03.2021 of the Principal Secretary to Government of Odisha, Bhubaneswar, School and Mass Education Department. It is kept in the case record.

The Court vide order dated 06.11.2020 in WP(C) No.20766 of 2020 has directed that; "Looking to the prayer involved herein and as this Court finds, decision has to be taken by the Secretary, School and

Mass Education Department, Bhubaneswar, O.P. No.2, this writ petition stands disposed of with a direction to the opposite party No.2 to consider the request of the petitioner involved therein by treating this writ petition as representation at the instance of the petitioner and take lawful decision thereon as appropriate, taking into account the judgments cited supra and also the Government Resolution dated 17.09.2013, as expeditiously as possible, preferably within a period of three months from the date of communication of copy of this order along with a copy of the writ petition by the petitioner."

As revealed from the order of the Government of Odisha, School and Mass Education Department dated 30.03.2021, the case of the petitioner was considered and the same was rejected being devoid of any merit. The relevant portion of the order is as follows:

"4. That, as per judgment of Hon'ble Apex Court in Uma Devi Case irregular appointments of duly qualified persons appointed against sanctioned posts who have continued to work for ten years or more without the intervention of the orders of the Court can be regularized as one time measure.

5. That, in the instant case, the petitioner is getting salary and continuing in the service with the

intervention of the orders of the Hon'ble Tribunal. Hence, this case is not covered as per the ratio of Uma Devi Case.

In view of the facts and circumstances stated above, the prayer of the petitioner for regularization of service is hereby considered and rejected being devoid of merit."

In view of the above order of the Government of Odisha, School and Mass Education Department, I find nothing left to be proceeded with this execution petition. Hence, the same is dismissed.
