01. No delay is reported as per the S.R. and hence, the I.A. is disposed of.

02. 1. Heard learned counsel for the petitioner.

2. Instant revision is filed by the petitioner challenging the impugned judgment dated 11th July, 2025 at Annexure-1 series of the learned Presiding Officer, OPID-cum Additional Sessions Judge, Berhampur in Criminal Appeal No. 57 of 2024 on the grounds stated.

3. Considering the plea advanced and the submission of learned counsel for the petitioner, the Court is inclined to issue notice to opposite party No.1 only.

4. Accordingly, it is ordered.

5. Notice to opposite party No.1 by Speed Post with a short returnable date and for the said purpose, requisites shall be filed by learned counsel for the petitioner within seven days from today.

6. List on 24th November, 2025 for hearing and orders.

03. 1. Heard.

2. Instant petition is filed for interim orders seeking release of the petitioner on bail during pendency of the revision.

3. Considering the fact that an amount of Rs.9 lac has been received by the petitioner, who, thereafter, issued the alleged cheque and its stood dishonored leading to the filing of the complaint, the Court is of the view that he should be directed to be released on bail subject to suitable conditions besides furnishing a deposit of Rs. 1 lac before the learned court below.

4. Accordingly, it is ordered.

5. Consequently, the petitioner is directed to furnish a deposit for an amount of Rs. 1 lac to be kept in a fixed deposit with the learned court below in any Nationalized Bank

renewable from time to times and upon complying the same to be released on bail in connection with 1.C.C. Case No. 356 of 2018 with such other suitable conditions imposed. It is further directed that in case the above direction is complied with, the NBWA issued against the petitioner in the meantime by learned JMFC (T), Berhampur shall not be executed.

6. List on the date fixed for further orders.

7. Issue urgent copy of this order as per rules.
