03. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. This interlocutory application has been filed by the State- Petitioner with a prayer to condone the delay in presenting the leave application before this Court.
3. Heard Mr. Sangram Das, learned Standing Counsel appearing for the Petitioner-Vigilance Department and Mr. P.C.
Das, learned counsel for the Accused-Opposite Party.
4. Learned Standing Counsel appearing for the Vigilance Department, at the outset, contended that there is a delay of 75 days in presenting of the leave application. While explaining the delay, learned Standing Counsel stated before this Court that since this is a leave application against the judgment of acquittal, some extra time was required to obtain administrative clearance to seek leave. He further submitted that there is some delay in preparation of the leave application. Accordingly, it was prayed that the delay be condoned in the larger interest of justice.
5. Mr. P.C. Das, learned counsel appearing for the Accused- Opposite Party contended that the delay has not been properly explained. He further submitted that delay in preferring the appeal has not been explained specifically. On such ground, learned counsel for the Opposite Party contended that the application for condonation of delay is devoid of merit and, accordingly, the same should be dismissed.
6. Having heard the learned counsels appearing for both sides, considering their submissions and on a careful examination of the record, it appears that there exists a delay of 75 days in presenting the leave application before this Court.
7. Taking into consideration the explanation given in the condonation application, this Court is inclined to condone the delay. Accordingly, the delay of 75 days in presenting the leave application is hereby condoned subject to the Petitioner paying a
sum of Rs.1000/- (Rupees one thousand)to the learned counsel for the Opposite Party within a period of two weeks from today.
8. The I.A. is disposed of accordingly.
9. List this matter in the week commencing 17th November, 2025 under the heading "For Admission".
