2. Heard learned counsel for the Petitioner as well as learned counsel for the State.

3. In course of his argument, learned counsel for the Petitioner refers to the judgment of this Court in Sanatan Mahakud vs. State of Odisha reported in 2023(I)ILR-CUT-1123 and submitted before this Court that the case of the Petitioner is squarely covered by the ratio laid down by this Court in the said judgment.

4. Learned counsel for the State sought for some time to obtain instruction and to examine the judgment.
