1. This matter is taken up through Hybrid mode.
2. Heard learned counsel for the Petitioner as well as learned counsel for the Informant and learned counsel for the State.
3. The present application has been filed at the instance of the convict Appellant for his released on bail.
4. Learned counsel for the Appellant at the outset contended that the present appeal has been filed by the Appellant assailing the judgment of conviction and sentence dated 04.09.2024 passed in
Spl. (POCSO) No.35 of 2020, which corresponds to FTSC Trial No.270 of 2021 by the learned Ad-Hoc Addl. District & Sessions Judge (FTSC) Bhadrak. He further contended that the Petitioner was found guilty and has been convicted under Section 363, 366(A), 376(2)(n), 506 of IPC read with Section 6 of POCSO Act and he has been sentenced to undergo rigorous imprisonment for a period of ten years and no separate sentence was imposed under Section 6 of POCSO Act even though he was found guilty under the said Section. The learned trial Court has also imposed a punishment in the shape of compensation to the tune of Rs.10,000/-. In addition to the victim compensation to the tune of Rs.5,00,000/-. Learned counsel for the Appellant submitted that the relationship between the Appellant and Victim was consensual as they were known to each other and had a love relationship. On such ground, learned counsel for the Appellant contended that the Appellant has a very good chance of succeeding in appeal.
5. Learned counsel for the Informant on the other hand objected to the release of the Appellant on bail on the ground of gravity and seriousness of the crime. In course of her argument, learned counsel for the Informant objected to the submission made by learned counsel for the Appellant that the Appellant had a consensual relationship with the Victim.
6. Learned counsel for the State also objected to the release of the Appellant on bail on the ground that the Appellant has been sentenced to undergo rigorous imprisonment for a period of ten years and as of now he has only been in custody for less than a year.
7. In view of the aforesaid factual position, this Court is not
inclined to entertain this bail application at this stage. However, in the event the appeal is not heard within a year from today, liberty is granted to the Appellant to move a fresh bail application.
8. With the aforesaid observation, the I.A. stands disposed of.
9. Preparation of paper book be expedited by the Office.
