Order 1. The appellants-State have filed the appeal challenging No.01.

the judgment dated 14.03.2024 passed in FAO No. 422 of 2019 by the learned Single Judge. The FAO has been filed challenging the judgment dated 30.12.2013 of the learned State Education Tribunal, Orissa, Bhubaneswar in G.I.A. Case No. 576 of 2011.

2. Mr. M.K.Sahoo, learned counsel submits that he has instruction to appear on behalf of respondent so the matter is listed for fresh admission. Vakalatnama of Mr. Sahoo shall be kept on record. Scanned copy be updated.

3. It is fairly stated by learned AGA for the appellant that the issue raised in the writ appeal is covered by the judgment dated 17.12.2024 passed by the Full Bench of this Court in Writ Appeal No. 2047 of 2024: Laba Kumar Rath Vs. State of Odisha & Others; 2025-(I)-ILR-CUT-1.

4. By the said judgment, it has been held (at paragraph-33(iii) which is reproduced herein) :

"33. In view of the above noted discussions, we answer the questions referred to the Full Bench as under:

xxx xxx xxx

(iii) We accordingly hold that an intra-court appeal shall not lie against an order passed by a learned Single Judge of this Court exercising appellate jurisdiction under a Special Act."

5. In view of the said proposition of law settled by the Full Bench, writ appeal is disposed of. However, the appellants shall have the liberty to seek legal remedy as available under law.
