The prayer in one of the petitions reads as under: ".... a writ of mandamus or an appropriate writ may be issued commanding the opposite parties to allow the petitioner to avail the leave benefits under the Orissa Education (Leave of Teachers and other Members of the Staff of Aided Educational Institutions) Rules, 1977, Retiral and Pensionary benefit under the Orissa Aided Educational Institutions' Employees Retirement Benefit Rules, 1981 and G.P.F. benefit under the Orissa Aided Educational Institutions Employees'

General Provident Funds Rules, 1983, as the petitioner is an employee of an aided educational institution;"

2. Learned counsel for the petitioner submits that all these writ petitions have a common fact matrix and therefore, similar law would govern them. He also brings to the notice of the Court that learned Single Judge of this Court has already accorded relief to petitioners of the kind and therefore, the same should be extended to them as well.

Learned AGA Mr. Lenka tells the Court that in identical matters, this Court has although granted reprieve in terms of the judgment of the learned Single Judge in WP(C) No.5022 of 2013 between Ritanjali Giri @ Paul v. State of Orissa and others, decided on 11.05.2016, the matter is put in challenge in Writ Appeal No.197 of 2024 is pending and therefore, the petitioners should await the final outcome of the said Writ Appeal.

Having heard learned counsel for the parties and having perused the petition papers, this Court is inclined to grant relief to the petitioners as has been granted in the coordinate case subject to outcome of the Writ Appeal, inasmuch as it is stated at the Bar that there is no interim order granted by the Division Bench.

Ordered accordingly, and these writ petitions are disposed off mutatis mutandis.

Now, no costs.
