01. This matter is taken up through hybrid mode.

2. Heard learned Counsel for the Petitioner so also Mr. Sahoo, learned AGA for the State, who accepts notice on behalf of the Opposite Parties and admits to have received copy of the writ petition.

3. Mr. Pattnaik, learned Counsel for the Petitioner, to substantiate the prayer made in the writ petition, files copies of the judgment of this Court reported in 2008(I)CLR-169 (Uttama Dei Vrs. State of Orissa) so also unreported judgment of this Court dated 23rd November, 2022 passed in W.P.(C) No.7511 of 2012 (Rajni Kanta Sahoo & others Vrs. State of Odisha & others). The said Judgments filed in the Court are taken on record.

4. Mr. Sahoo, learned AGA prays for four weeks' time to take instruction and file Counter. The said prayer is allowed.

5. The matter be listed in the week commencing from 30th June, 2025.

6. In view of the age of the Petitioner, who is around 85 years old and said to be suffering from cancer, learned Counsel for the State is directed to take instruction urgently and file Counter before the next date of listing after serving copy of the same on the learned Counsel for the Petitioner.
