ORDER
Order No. 07.05.2025
01. I.A. No.8739 of 2024 The matter is taken up through Hybrid mode.
2. This is an application for condonation of delay of 8 days in preferring the instant writ appeal against the impugned judgment.
3. It is stated in the application that though the judgment was pronounced in open Court on 08.11.2024, copy of the same could be made available only on 28.11.2024. It is further stated that the appellant stays in the city of Kolkata being employed there, he could not contact the advocate within the statutory period of limitation for filing the instant writ appeal and, therefore, there is delay of 8 days in preferring the same.
4. Though the respondents oppose the prayer for condonation of delay, after perusal of the above mentioned facts, we find that the appellant was prevented by sufficient cause in not filing the writ appeal within the time and, therefore, the delay of 8 days in filing the writ appeal is thus condoned.
5. In view of the above, I.A. stands disposed of.
6. List this matter on 25th June, 2025 under the heading "Fresh Admission".
