                                          ORDER

Order No. 06.03.2025 W.A. no.2170 of 2023 and I.A. 5882 of 2023

03. 1. Mr. Nayak, learned advocate appears on behalf of applicants-appellants. He submits, noting is confirmation of delivery of notice on track consignment report.

2. We have ascertained respondent nos.2, 3 and 4 had the items delivered to them as per track consignments dated 17th and 20th December, 2024. As such there has been good service. Mr. Mohanty, learned advocate appears on behalf of State.

3. Mr. Nayak prays for order on the application for condonation of reported delay of 685 days. He submits, cause shown is that his clients were unaware of impugned judgment dated 14th December, 2022 passed ex-parte against them at instance of State (petitioner). On becoming aware, certified copy was obtained and the appeal filed on delay.

4. Perused cause shown in the application. We accept the cause shown. The delay is condoned and the appeal admitted. The application is disposed of.

5. By consent list the appeal for hearing on 27th March, 2025. Mr. Nayak is requested to communicate website copy of this order to learned advocate, who had represented respondent nos.2 to 4 before the learned single Judge and file the acknowledgement on adjourned date.
