25.06.2025 I.A. No.142 of 2025 Order No.

01. 1. Heard Mr. Jena, learned counsel for the petitioner.

2. Instant I.A. is filed by the petitioner seeking condonation of delay in filing of the revision petition.

3. A delay of 268 days is reported as per the S.R.

4. However, Mr. Jena, learned counsel for the petitioner submits that the period consumed in obtaining the certified copy of the impugned order at Annexure-2 is to be excluded and with such exclusion, the delay becomes three days only.

5. Considering the submission as above, since the delay appears to be three days instead, the Court is inclined to condone the same under Section 5 of the Limitation Act accepting the explanation offered by the petitioner towards the same.

6. The I.A. is accordingly disposed of with the delay being condoned.

02. 1. Heard Mr. Jena, learned counsel for the petitioner.

2. Instant revision is filed by the petitioner challenging the impugned judgment in 1.C.C. No.203 of 2012 by learned J.M.F.C. (Transport), Berhampur on the grounds stated therein.

3. Considering the facts pleaded on record and submission of Mr. Jena, learned counsel for the petitioner, the Court is inclined to issue notice to the opposite parties.

4. Hence, it is ordered.

5. Notice vis-à-vis opposite party No.1 State is dispensed with. Issue notice to the opposite party No.2 by Registered Post with AD making it returnable at an early date and for the said purpose, requisites shall be filed by Mr. Jena, learned counsel for the petitioner within seven days from today.

6. List on 23rd July, 2025 for final orders.
