02. 1. Heard learned counsel for the Petitioner and learned counsel for the Govt. of India (ED).

2. Being aggrieved by the issuance of NBW by order dated 21.02.2025 by the learned Additional Sessions Judge-cum-Special Judge, CBI-I, Bhubaneswar in Crl. Misc. Case (PMLA) No.45 of 2021 in which the Petitioner is cited as accused no.5, the present ABLAPL has been filed.

3. Learned counsel for the Govt. of India (ED), Mr. Nayak opposes such prayer relying on the judgment of the Apex Court in the case of Tarsem Lal vs. Directorate of Enforcement Jalandhar Zonal Officer reported in (2024) 7 SCC 61.

4. Referring to the very judgment, learned counsel for the Petitioner submits that there is no bar

for the present Petitioner to invoke the jurisdiction of this Court for pre-arrest bail.

5. On considering the materials on record and taking into account the rival submissions, it is directed that the Petitioner shall take steps in accordance with law for redressal within a period of two weeks hence by appearing before the learned Court in seisin.

6. For a period of two weeks hence the operation of the order dated 21.02.2025 relating to NBW qua the Petitioner shall be kept in abeyance.

7. Accordingly, the ABLAPL stands disposed of.

8. U.C.C. as per rules.
