01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.
3. The present writ petition has been filed by the Petitioner with the following prayers:-
"It is therefore prayed that your lordship, may be graciously be pleased to issue a Rule Nisi in nature of Mandamus directing the Opp. Parties, to show cause as to why-
i) The petitioner will not be paid his Gratuity Amount of Rs.7,50,000/- with interest from dt.01.03.2010 in spite of
pendency of Vigilance Case. No. T.R. 19/2008.
ii) Pass any appropriate order.
If the Opp. parties will fail to show cause or show insufficient or false cause made the said Rule Nisi absolute and allow the writ petition."
4. It is submitted by the learned counsel for the Petitioner that the Petitioner wants to make a fresh representation before the authority concerned with a direction from this Court to the authority to consider the case of the Petitioner within a stipulated period of time.
5. Learned counsel for the State-Opposite Parties submits that he has no objection if the Petitioner is permitted to file a fresh representation before the authority concerned with a direction to the authority concerned to consider the representation of the Petitioner in accordance with law within a stipulated period of time.
6. Considering such submissions and without expressing any opinion on the merit of the case, this Court disposes of the writ petition permitting the Petitioner to make a fresh representation taking therein all the grounds along with the supporting documents before the Opposite Party No.1 within two weeks from today and in such event the representation filed by the Petitioner, the Opposite Party No.1 shall do well to consider the same by taking into consideration the law laid down by this Court in State of Odisha and others v.
Sushanta Chandra Sahoo and others, reported in 2022 (Supp.) OLR-447 and in Chittaranjan Senapati v. State of Odisha and another (W.P.(C) No.20808 of 2024 disposed of vide judgment dated 06.03.2025). Further, it is directed that the representation of the Petitioner shall be disposed of by the Opposite Party No.1 within a period of two months from the date of filing of such representation. The decision so taken on such representation shall be communicated to the Petitioner within a week thereafter.
