01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard the learned counsel for the Petitioner as well as the learned counsel for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.

3. The present writ petition has been filed by the Petitioner with the following prayers:-

"Therefore it is prayed that this Hon'ble Court may be pleased to direct the Opp. parties to disburse and sanction all the retiral benefits including the pension, Gratuity, cash of unutilized leave salary, TBA, ACP, RACP, MACP and commuted value of pension, which has been withheld, due to the pendency of the vigilance case No.35/2007 and now pending in the court of Special Judge, Vigilance , Sundargarh since last 18 years."

Considering the grievance involved in the present writ petition, the Petitioner is granted liberty to approach the Opposite Party No.1 by filing a detailed representation taking therein all the grounds along with supporting documents within a period of three weeks from today. In such eventuality, the Opposite Party No.1 shall consider the grievance of the Petitioner in accordance with law and keeping in view the law laid down by this Court in State of Odisha and others v. Sushanta Chandra Sahoo and others, reported in 2022 (Supp.) OLR-447 and in Chittaranjan Senapati v. State of Odisha and another (W.P.(C) No.20808 of 2024 disposed of vide judgment dated 06.03.2025). Further, it is directed that the representation of the Petitioner shall be disposed of by the Opposite Party No.1 within a period of two months from the date of communication of a certified copy of this order by passing a speaking and reasoned order. The final decision so taken be communicated to the Petitioner within ten days thereafter.

5. With the aforesaid observation and direction, the writ petition stands disposed of.
