01. 1. This matter is taken up through hybrid arrangement.

2. This application under Section 5 of the Limitation Act has

been filed for condoning the delay in preferring the FAO

No.184 of 2025.

3. Heard.

4. Considering the submissions made on behalf of the parties

and looking to the averments made in this I.A, this Court

condones the delay in preferring the FAO No.184 of 2025.

5. This I.A. is, accordingly, disposed of.

6. In filing this FAO, the appellants have challenged the

Commissioner for Employee's Date: 15-Jul-2025 18:05:43 Compensation-cum-Joint

Labour Commissioner, Bhubaneswar in E.C. Case No.30 of

2019.

8. Admit.

9. Issue notice.

10. Since the Respondent Nos.1 & 2 have already entered

their appearance through Mr. Ramesh Chandra Behera,

learned counsel, let the learned counsel for Appellants serve

two spare copies of the brief on Mr. Ramesh Chandra

Behera, learned counsel within three working days hence.

11. Notice be issued to the Respondent No.3 by Registered

Post with A.D./Speed Post making it returnable by 12th

August, 2025. Requisites for issuance of notice shall be filed

within three working days hence.

12. List this matter on 13th August, 2025.

13. Issue notice as above.

14. Accept one set of process fee.

15. As an interim measure, it is directed that the amount to

the tune of Rs.13,82,325/- deposited before the learned

Commissioner for Employees' Compensation, Bhubaneswar

in E.C. Case No.30 of 2019 shall not be disbursed till the next

date of listing of this matter.
