2. Non-compliance of direction in Judgment dated 05.05.2015
rendered in O.J.C. No.7854 of 1998 is alleged by Mr. Narendra
Kishore Mishra, Senior Counsel along with Mr. Nitish Kumar
Mishra, learned counsel appearing for the Petitioner. What has
transpired on earlier occasion in the Court is not unknown to Mr.
Prasanna Kumar Parhi, learned Deputy Solicitor General of India
along with Mr. Rajesh Kumar Mahapatra, learned Sr. Panel Counsel
representing the Union of India (Central Reserve Police Force) nor
Mr. Amitendra Nath Sinha, IPS, Inspector General of Police,
Odisha Sector, Central Reserve Police Force, Bhubaneswar, who
remained present in Court through virtual mode.
3. Today when the matter is taken up Mr. Prasanna Kumar
Parhi, learned Deputy Solicitor General of India seeks short

adjournment so as to facilitate the Opposite Parties in this petition
to comply with the direction contained in aforesaid judgment dated
05.05.2015
.
4. Mr. Narendra Kishore Mishra, learned Senior Counsel enclosing copy of show cause notice dated 12.02.2025, i.e., after passing of order dated 05.02.2025 in this contempt petition, submitted that the Commandant, 39th Battalion Central Reserve Police Force- Opposite Party No.3 (Contemnor) in the contempt petition in order to cover up the mistake instead of complying with the direction of this Court is trying to not only extend the period stipulated in the said judgment for compliance but also widening the scope of such direction. He vehemently submitted that such a course is impermissible. It is submitted that while the matter is in progress, the contemnor has no authority to issue show cause notice to the petitioner.
5. This Court takes serious view of the matter. However, as assured to this Court by the learned Deputy Solicitor General of India, this hopes that the Contemnors (Opposite Parties) in this petition shall be careful enough and mend their conduct. This Court trusts by the next date the order and direction contained in the judgment dated 05.02.2025 rendered in O.J.C. No.7854 of 1998 shall be complied in its true letter and spirit, failing which the learned Deputy Solicitor General of India shall furnish the names of all the contemnors with addresses on the next date for issue of show cause notice in contempt petition.
6. List this matter on 20.02.2025.
7. It is made clear that on failure to comply as reflected hereinabove this Court shall be constrained to proceed further in the contempt.
8. Copy of the show cause notice enclosed to memo dated 13.02.2025 filed by Mr. Nitish Kumar Mishra, learned counsel, in Court today is taken on record.
