01. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
This JCRLA has been registered on the basis of a prisoner's petition sent by the appellant Kanhu Charan Sahu, who along with others faced trial in the Court of learned Sessions Judge, Ganjam, Berhampyur in Sessions Trial No. 57 of 2023/Sessions Trial No. 58 of 2023 for commission of offences under sections 302, 120-B, 109 and 34 of the IPC read with sections 25 and 27 of Arms Act and has been found guilty under sections 302/34, 302/120B of the IPC and 25 & 27 of the Arms Act.
Mr. Soubhagya Ketan Nayak, learned counsel appearing for the victim in the case submits that the appellant Kanhu Charan Sahu along with other co- accused persons have already preferred CRLA No. 49 of 2025 before this Court challenging the self-same judgment and order of conviction and the appeal has been admitted vide order dated 13.01.2025. He has also produced the copy of the order passed in CRLA No. 49 of 2025, which is taken on record.
In view of such submission made by Mr. Nayak and the order passed in CRLA No. 49 of 2025 in which the appellant Kanhu Charan Sahu is the appellant No.6 in the said CRLA , this JCRLA stands disposed of.
This order be communicated to the appellant through the District Welfare Officer, Ganjam, Berhampur forthwith.
