2. Heard Ms. S. Das, learned counsel for the appellant. Perused the impugned judgments.

3. Considering the submissions and the grounds raised, the second appeal is admitted on the following substantial question of law:-

i. Whether the finding of both the courts below that the plaintiff was a defaulter in payment of rent from 01.01.2001is perverse being contrary to Exhibit-4?

4. Issue notice to the respondent by speed post fixing a short returnable date. Requisites be filed within three working days.

5. Call for the LCR.

6. List this matter in the month October, 2026.
