02. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application for interim bail filed by appellants on the ground that wife (Sufala Sahu) of the appellant no.2 and mother of appellant no.1 died on 02.12.2025 in the midnight and for performing the obsequie ceremony their presence is very much necessary and to that effect the certificate issued by the Sarapanch of Badakantakul Gram Panchayat has been annexed to the interim application.

Heard learned counsel for the appellants and the

learned counsel for the State.

Both the appellants have been convicted under sections 307/302/34 of the Indian Penal Code read with Section 25/27 of the Arms Act and were sentenced to undergo rigorous imprisonment for life and to pay a fine of Rs.10,000/- (rupees ten thousand) each, in default, to undergo R.I. for one year each for the offence under sections 302/34 of the Indian Penal Code, sentenced to undergo R.I. for seven years each and to pay a fine of Rs.5,000/- (rupees five thousand) each in default, to undergo R.I. for six months for the offence under section 307 of the Indian Penal Code; further sentenced to undergo R.I. for seven years each and to pay a fine of Rs.5,000/- (rupees five thousand) each in default, to undergo R.I. for six months each for the offence under section 25 of the Arms Act and sentenced to undergo R.I. for seven years each and to pay a fine of Rs.5,000/- (rupees five thousand) each in default, to undergo R.I. for six months rach for the offence under section 27 of the Arms Act and all the sentences shall run concurrently, as directed by the learned Additional Sessions Judge-cum-Special Judge (Vigilance), Angul in C.T.(S) No. 154 of 2021.

Perused the impugned judgment.

Learned counsel for the State has received the copy of the interim application and submits that she is not able to collect the information relating to such death.

Considering the averments taken in the interim application, the certificate issued by the Sarapanch annexed

to the interim application, we are inclined to release the appellants on interim bail for a period of twenty days from the date of their release. The appellants shall surrender before the learned trial Court on expiry of twenty days period.

For the above period, let the appellant-petitioner no.1- Shishira Sahu and appellant-petitioner no.2-Biswanath Sahu be released on interim bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) each with one local solvent surety each for the like amount to the satisfaction of the learned trial Court, subject to condition that before accepting the bail bond, the learned trial court shall verify whether the averments taken relating the death of "Sufala Sahu" is correct or not. If it is found that "Sufala Sahu" has died, then only the bail bond shall be accepted. Further, while on interim bail the appellants shall not indulge in any criminal activities in any manner and shall not come in contact with the family members of the deceased.

Violation of any of the conditions shall entail cancellation of interim bail.

The I.A. is disposed of accordingly.

Issue urgent certified copy of this order as per rules.

03. Put up this matter in the week commencing from 5th January, 2026.

Learned counsel for appellants shall file the surrender certificate of both the appellants on the next date.
