  20.       1.     When the matter was taken up on 04.12.2025, none had appeared for

the appellant. Today also when the matter is taken up, none appears for the appellant. The appellant's name was called in the Court as well as at the entrance of the Court outside. The appellant remains absent on repeated calls.

Despite issuance of notice by this Court to the Respondent by the coordinate Bench on 08.05.2014 and thereafter fresh steps having been taken as per the order dated 26.11.2014 by another coordinate Bench, 'Dusti' service being permitted by the said coordinate Bench, no one had appeared on behalf of the Respondent. Thereafter, substituted service was

undertaken as per order dated 21.07.2015 by publication in paper, i.e. in local Oriya daily 'The Samaja'.

2. Mr. J.K. Bal, learned Additional Govt. Advocate refers to the order dated 31.10.2025 and submits that the DSP-in-charge, Kundangari Police Station, district - Kendrapara in compliance of the order of this Court, has submitted his report, which is available in the record marked at Flags 'P' & 'M'.

3. After perusal of the said orders and the report, we have passed order dated 04.12.2025. It is evident that the appellant is not taking any steps after filing of the appeal. Accordingly, the appeal stands dismissed.

The interim order of status quo passed earlier stands vacated forthwith in view of dismissal of the appeal.

4. Copy of this order shall be forwarded to the learned Judge, Family Court, Rourkela to be kept in the record of C.P. No.52 of 2009 disposed of vide judgment dated 20.03.2014.
