2. Heard learned counsel for the petitioner and learned Addl. Government Advocate for the State.

3. The petitioner has been working as GRS in Subalaya Gram Panchayat under Bargaon Block in the district of Sundargarh since 10.12.2007. A performance report was forwarded by the BDO to the Chief Development Officer-cum-Executive Officer, Zilla Parishad, Sundargarh on 14.03.2024 in his favour endorsing the same as 'Good'. In spite of the above, while as many as 196 GRSs of different Gram Panchayats in the district of Sundargarh have been absorbed and appointed as Accountant-cum-Data Entry Operator as per order dated 02.08.2024 of the Collector-cum-CEO, Zilla Parishad, Sundargarh, the petitioner has been ignored.

4. The petitioner's grievance is that his case has not been considered, which he believes to be because of the pendency of a

vigilance case against him. In this regard, he cites a judgment passed by this Court in the case of Ashis Kumar Debta vs. State of Odisha & Ors (W.P.(C) No. 5838 of 2024, disposed of on 09.07.2024), wherein the provision of the Odisha Accountant-cum- Data Entry Operator (Method of Recruitment and Conditions of Service) Rules, 2024 have been interpreted.

Since no decision on the claim of the petitioner has yet been taken, the writ petition is disposed of granting liberty to the petitioner to submit a representation before the Collector-cum- CEO, Zilla Parishad, Sundargarh within two weeks along with copy of the judgment passed by this Court in the case of Ashis Kumar Debta (supra). On such representation being submitted within the period stipulated, the Collector shall consider the same in the light of the judgment passed by this Court and pass necessary orders in favour of the petitioner, if he is otherwise found to be eligible within a further period of one month.

6. The writ petition is disposed of.
