04. This matter is taken up through hybrid mode.

2. Learned Counsel for the Petitioner is present.

3. Pursuant to order dated 28.07.2025, a report has been submitted by the learned Judge, Family Court, Balasore (I/c), vide letter no.550 dated 05.08.2025, wherefrom it is revealed that C.P. No.453 of 2018 now stands posted to 25.08.2025 for hearing.

4. It is further revealed from the said report that, even though this Court passed a stay order, in view of the judgment of Supreme Court in Asian Resurfacing of Road Agency Private Limited & another Vrs. Central Bureau of Investigation, reported in (2018) 16 SCC 299, the Court below proceeded further and after failure of conciliation, now the matter stands posted to 25.08.2025 for hearing.

5. However, in view of the recent judgment in Asian Resurfacing of Road Agency Private Limited & another Vrs. Central Bureau of Investigation, reported in (2024) 6 SCC 307, the interim order stood extended vide order dated 28.07.2025 indicating therein that the same shall continue subject to pendency of C.P. No.453 of 2018. Hence, the Court below is directed not to proceed further without leave of this Court.

6. To give further opportunity to the Opposite Party- Husband, Office is directed to communicate a copy of this Order to the Court below, who shall do well to communicate the said order to the Opposite Party, who is the Petitioner in C.P. No. 453 of 2018 or his lawyer, who represents him in the said proceeding, and report compliance before the next date of listing.

7. The matter be listed in the week commencing from 13th October, 2025.
