01.   1.      Heard learned counsel for the Petitioners and

learned counsel for the State and.

2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.405 of 2019 pending on the file of learned S.D.J.M., Nayagarh arising out of Nayagarh Sadar P.S. Case No.111 of 2019 for commission of offences punishable under Sections 498-A/328/506/34 of the IPC read with Section 4 of D.P. Act.

3. It is submitted by the learned counsel for the Petitioners that the Petitioners were before this Court in ABLAPL No.2952 of 2020 which was dismissed as withdrawn on 25.02.2022.

4. It is stated that since charge sheet has already been filed custodial interrogation of the Petitioners is not necessary.

5. Learned counsel for the Petitioners further submits that on an the earlier occasion it could not be brought to the notice of this Court that by judgment dated 01.10.2020 passed by the learned Judge, Family Court, Nayagarh in C.P. No.72 of 2020 in a proceeding under Section 13(B) of Hindu Marriage Act at the instance of the wife the decree of divorce on mutual terms was granted and the marriage thus stood dissolved with effect from the date of decree.

6. Considering the same, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms and conditions as deemed just and proper.

7. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

8. Accordingly, the ABLAPL stands disposed of.

9. Urgent certified copy of this order be granted as per rules.
