1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. This I.A. application has been filed for release of the appellant-petitioner on interim bail.

3. Heard learned counsels for the parties.

4. It is stated by learned counsel for the appellant-petitioner submitted that the appellant, who has been convicted vide judgment dated 28.06.2024 of the learned Ad-Hoc Addl. District and Sessions Judge (FTSC), Angul in Spl. (POCSO) Case No.42 of 2020, has been serving a sentence of 12 years for commission of offence under Sections 341, 323, 294, 354, 376, 506 of IPC read with Section 4 of the POCSO Act. Learned counsel for the

appellant further contended that when the appellant was in custody, his mother passed away. The appellant was allowed to go on interim bail and on expiry of the interim bail, the appellant has surrendered and he has been sent back to the custody. He further submitted that the appellant want to release on interim bail to attend the 1st death anniversary of his mother which is scheduled to be held on 18.08.2025.

Taking into consideration the fact that earlier the appellant was released on interim bail and he has been surrendered in time, this court directs the appellant to release on interim bail for a period of two weeks starting from the date of his release from custody subject to such terms and conditions as would be deemed just and proper by the learned trial court. Further, it is directed that the appellant-petitioner shall not misuse the liberty. Violation of any of the conditions shall entail cancellation of the interim bail application.

6. On expiry of the interim bail period, the Appellant- Petitioner shall surrender immediately before the court below, failing which, it is open to the court below to take coercive action against the Appellant-Petitioner to ensure that the Appellant-Petitioner is taken back into custody. Surrender certificate of the Appellant-Petitioner be produced before this Court.

7. Accordingly, the I.A. is disposed of.

8. Issue urgent certified copy of this order as per Rules.

9. List this matter in the week commencing 01.09.2025.
